Terms of Service

1. Acceptance of Terms
By accessing or using SafeSwap (the “Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms in their entirety, you must not use the Service. Your continued use of the Service constitutes ongoing acceptance of these Terms as they may be amended from time to time.
2. Nature of the Service
The Service is provided strictly on a “best efforts” and “as is” basis, without warranty of any kind, whether express, implied, statutory, or otherwise, including without limitation any warranty of merchantability, fitness for a particular purpose, or uninterrupted availability. SafeSwap does not guarantee the execution, timing, or completion of any exchange transaction.
Exchange transactions are effected through third-party liquidity providers. SafeSwap acts solely as an interface to such providers and does not itself hold, custody, or control user funds at any time. The selection of liquidity providers is made at SafeSwap’s sole discretion.
3. Information We Collect
SafeSwap does not perform identity verification (“KYC”) and does not collect or store personal information about its users, with one exception: depending on how you access the Service, SafeSwap logs either your Telegram user identifier (when you use the Telegram service) or your Internet Protocol (IP) address (when you use the web service), as it is contractually required to do so by its third-party liquidity providers. This information is retained for the purposes of transaction attribution and compliance with the requirements of such providers.
Notwithstanding the foregoing, third-party liquidity providers may, at their own discretion and pursuant to their own policies, require identity verification or other personal information from you before releasing or refunding funds. Any such request is made by the provider and not by SafeSwap, and SafeSwap has no control over, and assumes no responsibility for, such requirements.
4. Disclosure to Law Enforcement
SafeSwap reserves the right, in its sole and absolute discretion, to disclose any information it holds — including your Telegram user identifier or IP address and associated transaction records — to law enforcement, regulatory authorities, or other governmental bodies, whether in response to lawful process or otherwise, where SafeSwap deems such disclosure appropriate.
5. Failed Transactions and Refunds
In the event that a transaction fails, is delayed, or otherwise does not complete as expected, SafeSwap will use commercially reasonable efforts to work with you and the relevant liquidity provider to effect the return of your funds. You acknowledge that the return of funds may be subject to the policies and requirements of the third-party liquidity provider, and that SafeSwap cannot guarantee recovery in all circumstances.
6. Your Obligations
You agree to send the exact amount of the designated asset specified for your transaction, to the address provided, within a reasonable time of initiating the transaction. Deposits that deviate from the specified amount, arrive after the applicable quote has lapsed, or are sent to an incorrect address may fail, be re-quoted, or require manual resolution, and SafeSwap assumes no liability for losses arising therefrom.
7. Representations and Warranties
By using the Service, you represent and warrant, on a continuing basis, that:
- you are the sole legal and beneficial owner of all funds you exchange through the Service, and such funds have been acquired and are held by you lawfully;
- you are not a citizen of, resident of, or located in the United States of America, and you are not otherwise a “U.S. person” as defined under applicable United States law;
- you are not named on any sanctions list, including without limitation the lists maintained by the U.S. Office of Foreign Assets Control (OFAC), the United Nations Security Council, the European Union, or His Majesty’s Treasury of the United Kingdom;
- you are not a citizen or resident of, or located in, any jurisdiction subject to comprehensive sanctions, including without limitation Cuba, Iran, North Korea, Syria, Russia, Belarus, Myanmar, Afghanistan, Venezuela, or the Crimea, Donetsk, or Luhansk regions of Ukraine; and
- no funds sent through the Service originate from, or have passed through, any sanctioned address, darknet marketplace, mixing or tumbling service, or other source designed to obscure the origin of funds.
Any breach of the foregoing representations constitutes a material breach of these Terms and may result in the suspension of your transaction, forfeiture of service, and disclosure pursuant to Section 4.
8. Limitation of Liability
To the maximum extent permitted by applicable law, SafeSwap shall have no liability whatsoever arising out of or in connection with the Service, howsoever caused and on whatever theory of liability, whether in contract, tort (including negligence), strict liability, or otherwise. Without limiting the foregoing, in no event shall SafeSwap be liable for any direct, indirect, incidental, consequential, special, or exemplary damages, including loss of profits or loss of digital assets, and you assume the entire risk of your use of the Service.
To the extent that applicable law does not permit the exclusion of liability set out above, SafeSwap’s aggregate liability arising out of or in connection with the Service shall in no event exceed the amount of the transaction giving rise to the claim.
9. Amendments
SafeSwap may amend these Terms at any time by posting the amended Terms on this page. Amendments take effect upon posting. Your use of the Service following any amendment constitutes acceptance of the amended Terms.
